Hāna and Beyond - Tour Terms & Conditions
1. Booking & Payments
For all Hāna and Beyond tours, payment must be made in full at least two weeks prior to the tour date to confirm your booking.
Partial payments or payment on the day of the tour are not accepted unless prior arrangements have been made and approved by us. Your reservation is not confirmed until full payment is received.
Accepted payment methods include credit cards (Visa, MasterCard, American Express) and Venmo. All prices are listed in US Dollars (USD).
2. Cancellations & Refunds

Customer Cancellations:

Cancellations made 48 hours before the tour start time will receive a full refund.

Cancellations within 48 hours of the tour are non-refundable.

No-Shows & Late Arrivals:

No refunds will be given for late arrivals or no-shows.

Company Cancellations:

We reserve the right to cancel tours due to safety concerns, weather conditions, natural disasters, low participation, or unforeseen circumstances.

In such cases, you will be offered a full refund or the option to reschedule.

3. Tour Changes
We reserve the right to alter or modify tour itineraries due to road closures, weather, safety issues, or operational reasons. In such cases, we will provide a comparable experience or alternative arrangements when possible.
4. Behavior & Conduct (Including Transportation)
All guests are expected to behave respectfully and follow all instructions from our staff, guides, and drivers at all times — both during the tour and while being transported in our vehicles.
We reserve the right to remove any individual from the tour — without refund — for:

Disrespectful, threatening, or aggressive behavior

Failure to follow safety instructions

Disruptive, illegal, or unsafe actions

Behavior that endangers the driver, other guests, or the operation of the vehicle

Consumption or being under the influence of alcohol or illegal substances before or during the tour
If a guest is removed for any reason, they will be responsible for arranging and paying for their own transportation from that point forward.
5. Assumption of Risk & Liability
You acknowledge that tours may involve physical activity, travel on uneven terrain, exposure to natural elements, and other risks. By booking, you agree to assume all risks associated with participation.
Hāna and Beyond, its employees, and affiliates are not liable for any injury, loss, damage, or expense incurred during the tour, except in cases of gross negligence.
6. Health & Physical Requirements
Our tours may involve optional walking and standing for extended periods, as well as navigating curbs, stairs, or uneven surfaces at various stops. However, it is not required to exit the vehicle, and guests are welcome to participate at their own pace.
If you are pregnant or have any medical conditions, mobility limitations, or other health concerns, we recommend speaking with your doctor before participating. Please let us know in advance if you may need special accommodations.
We reserve the right to deny participation if we believe it could compromise your safety, the safety of others, or the overall experience for the group.
7. Personal Belongings & Lost and Found
Guests are responsible for their personal belongings at all times during the tour. Hāna and Beyond is not liable for any lost, stolen, or damaged items, including but not limited to phones, wallets, cameras, and bags.
If you lose an item during the tour or while using our transportation services, please notify our staff as soon as possible. We will make reasonable efforts to locate and return lost items; however, we cannot guarantee their recovery.
Lost items must be picked up at our office. If our driver has a scheduled pickup at your resort, you may arrange to meet them there in the morning prior to their pickup. If no driver is scheduled to pick up at your resort, you will need to meet the driver at their first pickup location of the day.
If you are no longer on the island, we can ship your item to you at your expense.
Any found items will be held for a maximum of 14 days. After this period, unclaimed items may be donated or disposed of at our discretion.
To help prevent loss, we recommend keeping valuables secure and bringing only essential items on the tour.
8. Force Majeure (Unforeseen Events)
We are not responsible for any cancellations, delays, or changes to your tour caused by events outside our control. These may include, but are not limited to:

Natural disasters

Severe weather conditions

Road closures or landslides (including those along the Road to Hana)

Government actions or restrictions

Health emergencies or pandemics
-
Strikes, protests, or other disruptive events
In the event of a cancellation due to force majeure, we are not obligated to issue a refund. However, we will do our best to offer an alternative tour date, a credit for future use, or a partial refund when possible.
Each situation will be assessed on a case-by-case basis, and we appreciate your understanding as we prioritize guest safety and operational feasibility.
9. Media Release & Content Sharing
We may take photos or videos during the tour for promotional and marketing purposes. By participating, you grant Hāna and Beyond permission to use your image, likeness, and voice in such content, unless you notify us in writing before the tour begins.
In addition, by sharing or tagging us in photos, videos, reviews, or posts on social media or review platforms (including the use of our branded hashtags), you grant Hāna and Beyond a non-exclusive, royalty-free, worldwide license to use, repost, and publish such content for marketing, promotional, or informational purposes.
If you do not wish for us to use content you've shared, please contact us and we will remove it where possible.
10. Privacy
We only collect personal information necessary for booking and safety purposes. This may include your name, contact details, and any relevant health or dietary information. Your data is stored securely and not shared with third parties, except as required for service delivery or legal compliance.

11. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the State of Hawaii. Any disputes arising from or related to your tour with Hāna and Beyond will be subject to the exclusive jurisdiction of the courts located in Maui County, Hawaii.
